What is the distinctness of a new plant variety?




The requirement for a new plant variety to be "distinct" is similar to the "inventive" requirement for a patent, but they are not entirely equivalent as plant varieties cannot be assessed based solely on their inventiveness. This is because different plant varieties possess unique characteristics that cannot be evaluated solely based on their inventiveness. Therefore, the concept of "distinctness" is introduced to ensure that a new variety is sufficiently different from known varieties.
