What is the “transparency” principle?
The transparency principle is a fundamental aspect of the TRIPS Agreement, which aims to promote stability and predictability in international trade. This principle requires all member countries to increase transparency in their foreign trade administration. Specifically, laws, regulations, trade agreements, court rulings, and administrative decisions that are universally applicable must be made available to the public. However, exceptions to this disclosure requirement may apply when it would be harmful to law enforcement, the public interest, or the legitimate business interests of the parties involved.
