Patent Drafting and Specification Writing

The skill that separates an IP professional from an IP enthusiast.

Drafting is the hardest skill in patent practice and the one least well taught. Over eight weeks you will draft complete specifications from real invention disclosures and have every one reviewed line by line by a registered patent agent.

Duration
24 hours over 8 weeks
Level
Intermediate to advanced
Who it is for
Law graduates, IP paralegals, R&D engineers, aspiring patent agents

What you will be able to do

  • Draft independent and dependent claims that survive examination
  • Write a specification that supports the claims you want
  • Handle Markush structures, means-plus-function and omnibus claim issues
  • Draft for both Indian practice and PCT filing
  • Review and improve a draft written by someone else
  • Leave with a portfolio of drafts you can show an employer

What we cover

8 modules, delivered live over 24 hours over 8 weeks.

  1. 01

Week 1 — Reading claims like an examiner

Claim construction, scope, and why most drafts are too narrow or too broad.

  2. 02

Week 2 — The independent claim

Preamble, transition and body. Drafting from a disclosure, then defending your scope.

  3. 03

Week 3 — Dependent claims and fallback

Building a claim tree that gives you room to amend during prosecution.

  4. 04

    Week 4 — The specification

Field, background, summary, detailed description. Written support and enablement.

  5. 05

Week 5 — Drawings and reference numerals

Working with an illustrator, and the conventions examiners expect.

  6. 06

Week 6 — Difficult subject matter

Software, business methods, biotech and chemical claims under Indian practice.

  7. 07

Week 7 — Drafting for PCT and abroad

What changes when the same invention is filed in other jurisdictions.

  8. 08

Week 8 — Full draft and review
