Terms and Engagement Scope

These terms govern your use of this website and set out the basis on which MYCrave Consultancy & Services provides Intellectual Property services. They are written to be read, not to be dense.

Using this website

The guides, service pages and FAQs on this site explain how Indian IP law and procedure generally work. They are general information, not advice on your matter, and they cannot account for facts we have not seen. Reading this site, submitting a form or exchanging initial messages does not by itself create a professional relationship.

How an engagement starts

We begin work on a matter only after we have agreed the scope in writing, confirmed the fees and received any advance payable. That written scope governs the work; anything outside it is a separate engagement.

Fees

• Government fees are statutory, set by the registry, and payable to the government. They depend on applicant category — an individual, startup, small entity or educational institution generally pays less than a large entity — and on the number of claims, sheets, classes or designs involved.
• Professional fees are our charge for the work described in your scope.
• Optional stages — expedited examination, hearings, oppositions, additional searches and international filing — are quoted separately and only incurred if you instruct them.
• Taxes are applied as required by law and shown separately on the invoice.

Statutory fee schedules change. Figures quoted on this website or in a proposal are those current at the date shown; we confirm the applicable amounts before filing.

What we can and cannot promise

We can promise diligence, qualified professional handling and honest advice, including advice not to proceed where that is the right answer. We cannot promise that a patent, trademark or design will be granted or registered, that no objection or opposition will be raised, or that a registry will act within a particular time. Grant and registration decisions rest with the registry, and timelines depend on its workload.

Your responsibilities

Filings depend on the accuracy and completeness of what you give us. You are responsible for ensuring that the information, drawings, specifications and declarations you provide are correct, that you are entitled to apply, and that you tell us promptly about prior disclosures, prior use, earlier applications and deadlines. Missed deadlines can end rights irrecoverably; where a deadline is within your control we will tell you clearly, but we cannot act on information we do not have.

Confidentiality

We keep client information confidential, including unfiled inventions, brands and designs. See our privacy policy for how information is handled, and ask us for a non-disclosure agreement before sending detailed technical material if you prefer.

Third parties

Some work requires third parties — foreign associates for international filings, technical illustrators, or search database providers. We select them with care and tell you when their costs form part of a quote, but we are not responsible for their independent acts or for registry decisions.

Cancellation and refunds

You may end an engagement at any time. Government fees already paid to a registry are not refundable by us. Professional fees are payable for work completed up to the date you tell us to stop; any unused advance is returned. Where a matter is abandoned on your instruction, we will confirm in writing what rights lapse as a result.
